Conduct Required for Use of the Service
It is a condition of your use of the Service that you do not:
- Post, upload, perform or transmit any unlawful, threatening, abusive, obscene or pornographic information, material or images.
- Impersonate any person or entity or falsely state or otherwise misrepresent yourself or your band
- Otherwise act in an illegal manner
Content Submitted
The YouTube video can be of a live performance, rehearsal or promo nature but must depict the actual band/artist and not include content that Mcfly staff consider to be inappropriate. Otherwise the entry can be rejected or removed at any time. It is a condition of the contest and you hereby confirm you are responsible for the content you submit and that it does not contain...
- (a) Unlawful, threatening, abusive, obscene, or pornographic information or images.
- (b) Information that is fraudulent or infringes on the rights of others or infringes copyright or trademark of rights holders
- (c) Encouragement or instructions for spamming, hacking or similar activity
You shall be solely responsible for the content and the consequences of the video and your entry. You affirm that (1) you own or have the necessary licenses, consents and permissions to use and authorize Mcfly to use all copyright and trademark or other proprietary rights in and to any and all content; and permissions of each and every identifiable individual to use their likeness.
You agree that Mcfly is not responsible for any violations of any intellectual property rights in any content you submit. You hereby grant to Mcfly a perpetual, irrevocable, royalty free worldwide license to use, publicly display and modify the content that you submit. Any content you submit is deemed non-confidential.
Should Mcfly provide you with a password that allows you to access the content or contact info you will be solely responsible for maintaining the confidentiality of the password.
Mcfly has no obligation to monitor the use of the service by users. When participating in the contest please be sure that anything you say does not compromise your personal safety. Do not include phone numbers or other confidential personal info in the content.
Disclaimer of Warranties
You agree that your use of the site shall be at your sole risk. To the fullest extent permitted by law, Mcfly and their respective employees, sponsors, managers and agents disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. This site and Mcfly assume no liability or responsibility for errors, mistakes, incompleteness or inaccuracies of content or for any loss or damage or property damage or accident of any kind incurred as a result of the use of the content , participation in the contest or performance on the tour.
Indemnification
You agree to indemnify and hold harmless Mcfly and its agents, employees and managers for any claims, proceedings and any losses arising out of material posted by you.
Country
This agreement and issues arising from this site shall be governed by and in accordance with the laws of the United Kingdom.
